Securex is an international player in the field of social administration and HR for individuals, start-ups, self-employed, SMEs and large companies. As a full-service HR partner, we focus on the wellbeing and talent of employees, colleagues, clients and self-employed. Sustainable employability is important, for everyone. That is why we develop various solutions to preventively and proactively support the people involved.

In this context, Securex also develops and runs HR management solutions that help companies and their employees to streamline and support their major HR processes. With our Outsourcing activities, we aim to support employers temporarily and flexibly with an experienced professional to provide support when replacing an absent employee or when there is an acute shortage and/or when expertise is needed for a strategic or operational project.

The purpose of processing personal data

Personal data are processed in accordance with European Regulation (EU) 2016/679 of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as General Data Protection Regulation or GDPR) as a result of your registration as a candidate professional in our file with potential candidate employees or freelancers.

Your personal data will be processed for the following purposes: 

  • To find suitable experts and/or freelancers and establish a recruitment pool of internal and external candidate-experts and professionals who may be interested in becoming Securex employees and/or in fulfilling assignments with one of our client-employers quickly, flexibly, and efficiently. In order to gain further insight into candidates’ skills, requirements, and professional interests.
  • To screen, assess and select candidate-employees and experts in order to assign the right expert to the appropriate role and/or position.
  • To contact you in the event that we have an open assignment or position that could be interesting and to subsequently put you in touch with the client and/or potential employer.
  • Contract & Relation Management: 
      • The conclusion of an agreement between you and Securex.
      • For operational purposes, the execution and follow-up of performances and tasks.
      • To comply with our administrative and financial obligations as a result of the agreement and the related mandatory accounting. 
  • In order to gain further insight. 
  • To question you about your experiences with our services and our processes in order to further develop and improve our communication, services, and recruitment process. 
  • To further develop, support and/or improve Securex's global services or those of a third party.
  • For reporting and statistical purposes.

Legal basis for processing 

The legal basis for processing your personal data lies in Securex's legitimate interest to: 

  • Further support employers, entrepreneurs, partners, professionals, and our own employees on a daily basis at every stage of their career path and to provide them both proactively and reactively with solutions and opportunities as a reliable HR partner.
  • Create added value in our client relationships and improve the client experience for all stakeholders. 
  • Optimally organise, manage, and improve its business operations.
  • Assisting candidates and experts in the further development of their professional activities.

We will not share your personal data with potential employers and/or clients without your consent. 

If we believe that you are eligible for an assignment or if we think we can make you an interesting offer, we will always contact you first before sharing your personal data with others. 

Once an agreement is reached between you and the client and/or Securex, we will also process your personal data in execution and follow-up of said agreement and its legal obligations. 

Categories of people involved  

In this context, Securex processes personal data of Securex candidate employees, experts and freelancers, general candidates or interested parties and effective contractors of assignments with one or more of its affiliated employers. 

In this respect, your personal data may be provided directly by you, or indirectly by another organization or partner, or we may have collected them in our search for potential candidates and experts, relying on the information we find online through your use of social media or other platforms or publicly available sources. 

Categories of processed data

Personal data can be defined as any information relating to an identified or identifiable individual (data subject). 

Securex processes or may, among others, process the following data: 

  • Identification data
  • Contact data (address, phone number, e-mail, etc.)
  • Professional data (career, employer(s), job(s), experience, references, etc.)
  • Education and training
  • Data involving assignments (contract, remuneration, performance & timesheets, appraisals, etc.)
  •     

Some personal data are processed in your personal file, other personal data are necessary for the processing in relationship with the client. 

Data retention period 

Securex does not keep your personal data longer than strictly necessary for processing purposes and as long as required by law.

Without an actual agreement or assignment, we will keep your personal data for up to five (5) years after our last significant contact. 

If an agreement was reached, your personal data pertaining to this agreement will be kept for up to ten (10) years after termination of the last agreement. 

Confidentiality and data protection

In accordance with current legislation, Securex ensures an adequate level of protection for personal data. These measures include the technical and organisational measures required to protect personal data against accidental or unauthorised destruction, against accidental loss, as well as against the modification of, access to, and any other unauthorised processing of personal data.

Securex nonetheless points out that no protection system can guarantee 100% security. You can, however, always contact us for any questions on the confidentiality and security of your personal data.

Data recipients 

Your personal data are only processed and shared in accordance with the purposes provided:

  • Some of your personal data may be communicated to subcontractors, who provide specific services in the strict context of a subcontracting agreement and for the sole purpose of providing the required technical assistance to Securex. 
  • Your personal data may also be communicated to the HR department or to a manager of another legal entity of the Securex economic group should this be necessary or useful to Securex, to prepare or perform an assignment or agreement and only if this would be to your benefit. 

Unless you object or unless otherwise agreed, relevant and professional data may also be shared with clients or prospects in order to put you in touch with them. Your contact or other data will not be shared or made available without your consent, not even with potential clients.

In exceptional cases, Securex could be forced to provide specific personal data to the monitoring authorities, to our lawyers, to our experts or to legal bodies. 

Transfer of data to third countries

Securex does not transfer personal data outside the European Economic Area. 

Should a data transfer to a country outside the EEA nonetheless be required for the performance or provision of services, Securex will implement appropriate safeguards in accordance with data protection legislation and ensure that data subjects have enforceable rights and effective remedies. 

In order to guarantee that enforceable rights and efficient remedies are available to data subjects, processing and transfer may only take place under one of the following conditions: 

  • The transfer takes place to a country that ensures an adequate level of protection based on the European Commission’s adequacy decisions.
  • The transfer goes to a (sub)processor to which Binding Corporate Rules apply. These company rules guarantee an adequate level of protection. 
  • The transfer is made to a (sub)contractor where an additional model agreement made available by the European Commission (Standard Contractual Clauses, see (EU) 2021/914 of 4 June 2021) has been concluded and where an additional prior risk analysis has been conducted as well. The contractual provisions and any additional measures following a prior risk analysis or data transfer impact assessment should provide the required safeguards in terms of data protection. 

If there are no appropriate guarantees as to the level of protection, Securex will only transfer (or allow the transfer of) personal data to such third countries with the consent of the data subject.

Your rights

You can find out about the data processed by Securex Outsourcing and, if necessary, have them rectified by means of a dated and signed request, emailed together with a copy of the front of your ID card to the address privacy@securex.be or by post to Securex Group, Data Protection Officer, avenue de Tervueren 43, 1040 Brussels.

You may also object to the data processing or request that such processing be restricted in accordance with the same terms, and within the limits set by the GDPR. You can also request that your data be deleted or transferred. Further information is available at the same address.

Should you believe that there is a breach with respect to the processing or your rights, you can always lodge a complaint with the Data Protection Authority.
